by the LPA’s since the last meeting. 3. To consider and comment upon the following planning applications. (a) 07/01637 Butlers Hall, Littley Green Road, Great Waltham for erection of cart lodge and store. Comments : The Parish Council has no objections to the application but note a concern expressed by the neighbour regarding a possible problem with the water table as a result of the development. (b) 07/01719/FUL Redes, Main Road, Ford End –Proposal - Single storey 5 bay cartlodge. (i) The Parish Council believes that the plans are inaccurate as regards the boundary and the ownership of a boundary fence to be replaced. It is believed that the fence referred to is not owned by the applicant. (ii) The Parish Council expresses concern regarding potential light impact on neighbouring dwelling. (iii) The Parish Council have noted that Tree Preservation Orders were recently served on this site and ask CBC to bear in mind the impact of the development upon those TPO’s. (iv) The Parish Council asks that a condition be imposed to only allow the building to be used as ancillary to the existing dwelling for private use only by the resident. (c) 07/01664/FUL, 7 Duffries Close, Great Waltham, - Proposal Single storey extensions to front and rear. Proposal Replacement dwelling. Comments : The Parish Council would however point out that there are policies within the Chelmsford Borough Local Plan which do not support this application. Additionally there is a guideline within the Great Waltham Village design statement which says ‘There is no support for further ‘executive’ properties’. This guideline was published in 2002 and was considered by the Parish Council who felt that the VDS may now require review. |

Comments: The Parish Council is unable to support this application as it is contrary to the Chelmsford Local Plan policies. 07/02088/FUL Robins, Parsonage Lane, Howe Street, Proposal Conversion of garage to habitable space with rear extension and single storey side extension. Comments: The extension to the garage will result in a loss of light to the neighbouring property. The proposed new entrance to the site is immediately adjacent to the pedestrian entry to Howe Street Playing Field and almost opposite the junction of Parsonage Lane with Lucks Lane. The proposed new entrance in this position will increase the danger for users of the field and the junction. The addition of a bedroom to this dwelling will effect the availability of smaller dwelling in the housing stock within Howe Street village. |

Comments: The Parish Council welcomes the use of redundant farm buildings for this purpose. (b) 07/02350/FUL Red Barns, Warners Farm, Main Road, Howe Street for change of use of redundant agricultural building to B8 storage use. Comments: The application for storage implies traffic movement for the delivery and collection of the items stored. There is no information on the application form relating to traffic movements except to indicate current nil and future nil although there is one reference to ‘unknown’. The Parish Council are concerned that the use of the building for storage purposes could generate traffic. The building proposed for storage is close to the main A130 and all traffic movements to and from the site should be via the A 130 and no movement of traffic should take place through Howe Street village. The Parish Council requests that the planning officer investigates the traffic movements involved with the proposed storage more deeply and should it be found that traffic movements are involved that a fresh application is made which can then be considered by the Parish Council. (c) 07/02427/FUL 10, Fanners Green, Great Waltham for two storey side extension. Comments: The Parish Council welcomes the enhancement of this property. (d) 07/02351/FUL 2, Duffries Close, Great Waltham for demolition of single storey side accommodation and replacement with part two storey part single storey side extension together with single storey rear extension. Bay window and porch alteration together with new vehicular access. Comments: The Parish Council has no comments to make on this application. Report of the Planning Committee meeting held on Thursday 3rd March 2008 at Great Waltham Village Hall 1. Record of Members present Chairman: Mr Jackson Councillors: Messrs Huggins, Braisby, Blaber, Micklem, and Greenwood. Also Present: Mrs V Healy, Mr L Healy, Mr J Rowntree and Mr K Derry 2. Apologies for Absence Were received from Mrs Dickinson, Mrs Harper, Mr Bell and Mr Steel 3. Declarations of interests (existence and nature) with regard to items on the agenda. There were none 4. Public Participation session with respect to items on the agenda. Mrs V Healy spoke regarding item 6a describing the application and indicated that a previous application for conversion of the garage into habitable accommodation had received planning permission. This application was for an in and out driveway and to increase the hard standing to the front of the house. This she claimed would improve road safety, the highway could be accessed in forward gear and the site lines for egress onto the highway from the property were improved. Mr J Rowntree spoke regarding item 6a and pointed out that although Lucks Lane was no entry at one end there were two way vehicle movements within Lucks Lane. Mr Rowntree pointed out that the drawing accompanying the application did not show an in and out driveway. He further pointed out that if the garage were used then there would be space for three cars. Mr Rowntree indicated that an in and out driveway would be better than what was currently there. Mr K Derry read a statement which commented upon the objections which had been made by three residents of Bridgecroft regarding the planning application 6b. Mr Derry’s statement gave explanations of his point of view on each of the areas of concern made by the objectors and made comments in support of the application. Mr Derry felt that the application would enhance the cul-de-sac. 5. Report of Planning Applications determined by the LPA’s since the last meeting. There were no determinations to report. 6. To consider and comment upon the following planning applications. (a)08/00247/FUL Robins, Parsonage Lane, Howe Street for creation of new vehicle crossover. Comments: The Parish Council understands from the applicant that the application is for an in and out driveway. This is not clear from the drawing provided with the application. The Parish Council wishes to support an in and out driveway. (b) 08/00260/FUL 12, Bridge Croft, Howe Street, for two storey side extension, front porch and detached garage. Two letters commenting adversely on the application and one letter of support for the application were read to the meeting. Comments: The Parish Council expresses concern as follows: (i) The proposal is a rather large expansion of the house from four to six bedrooms. (ii) Even with the revised plans for the garage it remains a cause of concern as it would infringe upon the openness of the cul-de-sac area. (iii) The landscaping at the front of number 12 would virtually disappear. (iv) The proposed development upsets the balance of the housing stock within the cul-de-sac. (v) The changes will detract from the appearance and nature of the cul-de-sac and may create a precedent for further applications to develop large properties. (vi) The effect regarding the impact of the extension upon the neighbouring garden. (vii) Should the application be approved the Parish Council expresses concern regarding the future of the trees on the site. (c) 08/00299/FUL Duffries Cottage,South Street,Great Waltham, Proposal Single storey rear extension. Comments: The Parish Council supports this application as it enhances the character of the building. (d) 08/00300/LBC Duffries Cottage, South Street, Great Waltham for Removal of existing sun lounge wall and roof, removal of existing ground floor bedroom and construction of new sun lounge and bedroom on ground floor. Comments: The Parish Council supports this application as it enhances the character of the building. (e) 08/00234/FUL The Green Man, Main Road, Howe Street Proposal Application to reduce the entire height of the existing timber fence to the front of the premises to 1.2m high and to be painted green. Comments: The Parish Council supports this application as it enhances the character of the building. The Parish Council would however prefer the fence to be stained in a brown colour rather than painted green. 7. Sodium Lights at Jobs Orchard, Breeds Road, Great Waltham. Mr Greenwood spoke of a complaint which he had received regarding the orange sodium lighting installed at Jobs Orchard, Breeds Road, Great Waltham and the effect this had on light spillage in the surrounding area. It was agreed to refer the matter to Chelmsford Borough Council Environmental Services Department to enable advice to be given to the owner of the land which would allow the lighting system to be improved so that it was not so intrusive on the surrounding rural area. |

Mrs Palmer and Mr Gowers spoke against the proposal for the erection of a bungalow in the garden of number 28, Cherry Garden Road, Great Waltham on the grounds of overdevelopment, parking problems, omissions on the application and foul drainage issues. 5. Report of Planning Applications determined by the LPA’s since the last meeting. There were none. 6. To consider and comment upon the following planning applications. (a) 08/00582/FUL 28, Cherry Garden Road, Great Waltham for erection of bungalow. Comments: 1. The Parish Council feels that the proposal does not fit within the layout of Cherry Garden Road. In the immediate area of the proposed development locally known as ‘the square’ there is a symmetry to the design and layout of the development which would be destroyed by the proposed development, to the detriment of the appearance of the area. 2. The plans accompanying the application make no mention of the demolition of part of the existing dwelling (No 28, Cherry Garden Road). The proposals would not be possible without the partial demolition. 3. The proposed development would reduce the number of ‘off road’ parking spaces within Cherry Garden Road which already suffers from severe parking problems as a result of the lack of dropped kerbs that can be provided to gain access directly to houses which lie to the back of the grassed areas. The roadway is also narrow. The proposal indicates that two off road parking spaces would be provided for the new dwelling – it is difficult to see how this can happen without the removal of further hedging (the application indicates that no hedging will be removed). Furthermore the existing dwelling number 28 currently has two off road parking spaces. If the development is carried out number 28 will have no off road parking space. 4. The Parish Council comment that all hedges and trees should be retained. 5. Foul drainage in Cherry Garden Road has severe difficulties with the existing demands and this proposal would lead to an exacerbation of that problem. In this particular area the foul sewage has ‘backed up ‘ on several occasions. In 2007 Chelmsford Borough Council wrote to the residents of Cherry Garden Road following drainage problems indicating that blockages in the foul sewer would be charged to the residents. 6. The proposals are contrary to the Great Waltham Village Design Statement which says in relation to Cherry Garden Road ‘In addition to the general guidelines shown, the following points apply:

The Beehive, Mrs T Harper declared an
interest. Comments; 1. The Parish Council
wish to support local business and the continuation of the Beehive
Public House. 2. Concern is expressed
regarding the proposal to site the smoking shelter to the front of the
building. 3. It is felt that the
proposed siting of the smoking shelter will: (a) cause a loss of
privacy to the dwelling opposite the site – The Old Vicarage. (b) result in noise and
disturbance to neighbours as has been experienced since the beginning of
the smoking ban in July 2007, particularly when sporting fixtures have
been held on the large screen TV. (c) interfere with
sightlines of vehicles leaving the car park. (d) interfere with
pedestrian movements within the fenced off area of the public house
premises. (e) be in a hazardous
position in relation to the blind corner at the junction with the main
road. It is felt a possibility exists that vehicles could collide with
the structure. 4. It is suggested that
the smoking shelter should be located to the rear of the public house by
making a doorway at the back end of the passageway outside the village
bar. (b)
ESS/18/08/CHL Broads Green Gravel Pit, Margaret Woods Road, Broads Green
for importation of inert materials to restore old gravel workings for
development of land for agricultural use. Mr A Micklem declared an
interest Comments;
The Parish Council
encourages the proposed restoration of the former Broads Green Gravel
Pit site but has concerns regarding the proposals as follows. The proposal indicates
that 85,161 cubic metres of inert material will be imported over a 12-18
month period. The Parish Council asks what is ‘inert’ material. What
form does inert material take? What is allowed to be included as inert
material and what is not? Who and how will the imported inert material
be monitored to ensure that it is inert material and that the site is
not just being used as a dumping ground? This requires clarification. The application states that the restoration is to return the land for agricultural use, yet on page 11 of the application in response to question A21 (i) Summarise the intended afteruse or uses – the application states agriculture ‘No’ and Amenity ‘Yes’. This needs to be clarified. The application states on
page 11 question A22 a total of 86,161 cubic metres whereas other parts
of the application refer to 85,161 cubic metres. This requires
clarification. The application states on
page 11 question A22 that 200mm of topsoil and 800mm of subsoil over an
area of 8.3 hectares. The application also mentions 85,161 cubic metres
of inert material. Does this
85,161 cubic metres of inert material include both subsoil and topsoil?
This matter requires clarification. The report attached to
the application states that the old Pit Office is derelict and that a
separate application will be submitted for this. The application ignores
the fact that an existing planning permission
has already been gained on the redevelopment of the office. It is
therefore unclear whether it is proposed that the planning application
will be resubmitted. This requires clarification. The Parish Council are
very concerned regarding the lorry (traffic) movements from the site. It
is not clear which direction these vehicles will be travelling although
mention is made on the application page 7 A4 (iii) they will be directed
into the site via a left turn and exit via a right turn and use
unclassified roads to the wider highway network. The Parish Council
feels that all the unclassified highways leading to/from this site are
inadequate for the proposed use. However the favoured route from the
Parish Council’s point of view would be using Margaret Woods Road and
Breeds Road towards Chignal Smealey and onwards using Chignal Road to
Chignal Road Corner, Chelmsford and then into the wider highway network.
On no account should any traffic generated from the application site be
permitted to use The Parish Council are
very concerned regarding the damage to the highway and the highway
verges caused by the use of these inadequate roads by heavy vehicles
over a long period. The Parish Council is
very concerned regarding the length of time that the proposal will take.
The application states that the importation of material will take place
over a period of 12 – 18 months. The Parish Council would wish to see
a condition made on the granting of permission to set a time limit on
this application to ensure that following 18 months no further
importation of inert material be
permitted. The Parish Council
appreciates that the proposal will have a huge impact to the neighbours
of the site, from noise, fumes, dusts etc and request that Essex County
Council, in permitting this restoration,ensures that conditions are
imposed to minimise the effect on neighbouring properties and on
residential dwellings along the proposed transport route. This should
include wheel washing facilities, regular highway cleansing and sweeping
operations. The northern part of this
site has been prolific with bee orchids and great care should be taken
in the restoration of this part of the site to preserve the habitat to
allow these rare species to survive. |

UTT/0402/08/FUL Construction of highways and associated landscaping and
ancillary works associated with the G2 Airport project. (d)
UTT/0403/08/FUL – Change of use from use as agricultural land to use
for nature conservation and/or landscaping, and engineering operations
associated therewith, which comprise offsetting proposal associated with
the G2 Airport project. The four applications
above were considered as one and comments made as follows: Comments. 1. The Parish Council objects to all four applications forming the BAA Stansted application for Generation 2. 2. The Parish Council does not accept the premise that there is a need for airport expansion in the South East. 3. The loss of 442 ha of prime agricultural land is to be deplored, particularly given the worldwide food shortages. 4.
The additional CO2 emissions from an expanded Stansted (11 million tons
per annum) will exacerbate the problems associated with global warming
and will prevent the Government from meeting its obligations under the
Kyoto Agreement. 5.
The loss of villages which are proposed to be swallowed up by the
development of the BAA Stansted Generation 2 application is deplored. 6.
The loss of historic buildings as a result of the proposed development
of the BAA Stansted Generation 2 application is deplored. 7.
The applications takes no account of the need for additional road/rail
infrastructure to support additional vehicles and passengers. 8.
Many communities will be affected by additional noise, the need for
additional housing, and urbanisation. This will cause severe erosion of
these communities. (e)
08/00968/FUL Well House Farm. Comments:
The Parish Council has no objection to the proposed development
provided that a condition is made that the development will be and will
remain for the future ancillary to the use of the main dwelling, and
will not be considered to be a separate property.
